Terms of Service

1. Acceptance of Terms

By accessing and using Polymarkets Kenya ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. These terms constitute a legally binding agreement between you and POLYMARKETS KENYA LIMITED, a company incorporated in Kenya.

2. Eligibility

You must be at least 18 years old to use Polymarkets Kenya. By creating an account, you confirm that you meet this age requirement and that all information provided is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials.

3. Account Responsibilities

You are solely responsible for all activity on your account. You must not share your login credentials, engage in fraudulent activity, manipulate markets, or violate any applicable laws. We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

4. Platform Services

Polymarkets Kenya provides a prediction markets platform where users can trade on the outcomes of future events. We are not a bookmaker, gambling operator, or betting platform. We do not take positions against users and we do not earn revenue from users' losses.

Our sole source of revenue is a transparent commission (spread) embedded in every transaction — applied equally to all trades regardless of which outcome ultimately wins. This means our interests are aligned with yours: we succeed when trading volume is healthy, not when any particular outcome occurs.

All trading involves risk, and you may lose your entire stake. We facilitate trading through an automated market maker (AMM) but we do not guarantee market outcomes or investment returns.

5. Trading & Selling

You can buy shares in any open market outcome. You can also sell your position at any time before a market resolves. The automated market maker will buy back your shares at the current market price, allowing you to lock in profits or cut your losses without waiting for the final outcome. Selling prices are determined algorithmically and may differ from your purchase price.

6. Market Resolution

Markets are resolved based on objective, verifiable outcomes from reputable sources. Polymarkets Kenya has final authority on all market resolutions. We may cancel or re-resolve markets if errors occur, and in such cases, stakes may be refunded. Disputes about market outcomes will be handled at our sole discretion.

7. Deposits & Withdrawals

All deposits and withdrawals are processed through our approved payment providers. Processing times may vary. We reserve the right to verify your identity before processing withdrawals and may request additional documentation. Withdrawal limits and fees may apply as outlined on the Platform.

8. Taxes & Compliance

You are solely responsible for determining and paying any taxes applicable to your trading activity and winnings. Polymarkets Kenya does not provide tax advice. You must comply with all applicable laws in your jurisdiction, including any regulations regarding prediction markets, gambling, or financial trading.

9. Prohibited Activities

You must not engage in:

• Market manipulation or fraud
• Money laundering
• Collusion with other users
• Automated trading (bots) without prior approval
• Any activity that undermines the integrity of the Platform

Traders interested in algorithmic trading should contact us for API access. Violation of these rules may result in immediate account termination and forfeiture of funds.

10. Limitation of Liability

Polymarkets Kenya is provided "as is" without warranties of any kind. We are not liable for losses resulting from market outcomes, technical issues, third-party service failures, or unauthorized account access. Our total liability to you shall not exceed the amount you have deposited on the Platform in the past 12 months.

11. Dispute Resolution

In the event of any dispute arising from these terms or your use of the Platform, the parties agree to first attempt resolution through good-faith mediation. If mediation fails, disputes shall be resolved in the courts of Kenya under Kenyan law. Both parties consent to the exclusive jurisdiction of Kenyan courts.

12. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be notified via email or platform announcement. Continued use of Polymarkets Kenya after changes constitutes acceptance of the updated terms. We recommend reviewing these terms periodically.

13. Intellectual Property

All content, trademarks, logos, and intellectual property on Polymarkets Kenya are owned by POLYMARKETS KENYA LIMITED or our licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

14. Account Termination

You may close your account at any time by withdrawing all funds and contacting support. We reserve the right to suspend or terminate accounts for violations of these terms, suspicious activity, or at our discretion. Upon termination, you must cease all use of the Platform.

15. Privacy & Data

Your use of Polymarkets Kenya is also governed by our Privacy Policy. We collect and process personal data in accordance with Kenyan data protection laws (Data Protection Act, 2019). By using the Platform, you consent to our data practices as described in our Privacy Policy.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them valid and enforceable.
